This Privacy Policy outlines how we collect, use, and protect the personal information of users ("you" or "users" or “agency” or “seizers” or “Recovery Agency” or “Seizing Agency” or Collection Agency) of our EasySeizing-Premium mobile application and the EasySeizing-Premium.com web application. By using our services, you consent to the practices described in this Privacy Policy.

EasySeizing-Premium is India's first fully automated mobile and web application designed for Seizer, Recovery, and Collection Agencies. Our platform streamlines agency operations with secure user registration, GPS tracking, and compliance management, ensuring an efficient and user-friendly experience.

We recognize the trust you place in us when you use our platform, and we are fully committed to safeguarding your personal information. This Privacy Policy ensures that you understand what information we collect, why we collect it, and how it is used and protected. Our commitment reflects our dedication to complying with the highest standards of privacy laws, ensuring your rights and data are always respected.

1. Effective Date

• 1.1. EasySeizing-Premium was first released and made available to Agencies and their End Users on 07-05-2023. This Privacy Policy, as revised and updated from time to time, governs your use of the Platform. The version of this Privacy Policy applicable to your use of the Platform is the version in effect at the time of such use, as indicated by the "Last Updated" date stated above. Each revised version supersedes prior versions with effect from its own "Last Updated" date and does not retroactively alter the terms that governed your use of the Platform prior to that date.
• 1.2. We may update or revise this Privacy Policy from time to time to reflect changes in our practices, services, technology, or applicable law. Any revised version will be posted on the Platform along with an updated "Last Updated" date. Access to the Platform is conditioned on the Agency's or End User's explicit acceptance of the then-current version through the Platform's in-app acceptance process, and access is not permitted to continue until such acceptance is provided. Your acceptance of a revised version constitutes your agreement to be bound by that version, which shall then govern your use of the Platform.

2. Age Restriction Policy

• 2.1. Age Requirement: Our services are designed for and directed towards adults, specifically those who are Eighteen (18) years of age or older. We do not knowingly collect, use, or solicit personal information from anyone under the age of Eighteen (18).
• 2.2. Proactive Measures: In our registration process and at various points of interaction with our services, we take proactive steps to verify the age of our users, ensuring compliance with our Eighteen (18) years of age policy.
• 2.3. Parental Control: If any Parent or guardian discovers that personal information has been collected from an individual who is a minor without verifiable parental consent, please contact us at bigbyteall@rediffmail.com. We will take immediate steps to delete such information from our records and terminate the said account.

3. What Information Do We Collect?

We are committed to collecting only the information necessary to provide and improve our services while ensuring compliance with privacy regulations. We collect personal information about you in the following ways:

• 3.1.1. Information You Provide to Us:
  • 3.1.1.1. Registration of Agency:
    • 3.1.1.1.1. When you register your agency in our platform we collect key personal information, including but not limited to Agency Name, Registered Office Address, Owner Name and Contact Number. Once registered, the agency has the option to collect and input additional user details while registering their members.
    • 3.1.1.1.2. Once an agency is registered on the platform, it cannot change its name or transfer ownership to another party. If an agency wishes to operate under a different name, they must purchase and register as a new agency. This policy ensures transparency and prevents unauthorized changes in agency ownership.
    • 3.1.1.1.3. As part of our onboarding and verification process, we may also collect proof of the Agency's lawful business existence, such as its Shop and Establishment Registration (Gumasta) Certificate, Udyam Registration Certificate, Goods and Services Tax (GST) Registration Certificate, or any other applicable statutory or regulatory registration document, as may be furnished by the Agency. Such documents are used solely for verifying the legitimacy of the Agency prior to granting access to the Platform and are not shared with any third party except as required by law or as necessary to comply with a valid legal or regulatory request.
  • 3.1.1.2. Registration of Seizer:
    • 3.1.1.2.1. Agencies register seizers (end-users) under their profile. The platform itself does not allow individuals to register directly.
    • 3.1.1.2.2. End-users (seizers/recovery agents) are registered by their respective agencies.
    • 3.1.1.2.3. Once registered with an agency, an end-user cannot log in to another agency using the same mobile number unless the current agency has marked them as inactive in the system.
  • 3.1.1.3. Financial data: We collect information provided by agencies from financial institutions regarding vehicle recovery. This includes key details such as vehicle identification, loan status, outstanding dues, repossession history, and payment defaults. Such data helps agencies track assets, assess financial risks, and facilitate the recovery process in case of loan delinquencies.
• 3.1.2. Information from Third Parties:
  • 3.1.2.1. We may collect or receive information about agencies or seizers from third-party partners and integrate this data to enhance our services. However, we only store verified information provided by registered agencies, NBFCs, or finance companies.
• 3.1.3. Automatically Collected Information:
  • 3.1.3.1. We may automatically collect certain information when you use our platform, including your device's IP address, operating system, browser type, and usage patterns within our platform. We also collect and process your GPS location information to provide you with location-based services and enhance your user experience along with your phone number for OTP (One-Time Password) verification during the registration or login process.
  • 3.1.3.2. In-App Search Queries: We store the search queries (such as vehicle number or chassis number lookups) that you enter within the app. This information is used to provide app functionality, maintain a searchable history for your agency, and for security and audit purposes.
• 3.1.4. Photos and Videos:
  • 3.1.4.1. Where a vehicle or asset is subject to a legitimate seizure, repossession, or recovery process initiated by a registered Agency in accordance with the underlying loan/financing agreement, the Agency's field agents may capture photographs and videos of that specific vehicle/asset as documentary proof of its condition and of the recovery process.
  • 3.1.4.2. These images are uploaded to our servers solely for record-keeping, dispute resolution, and compliance purposes related to that recovery process, and may include location (GPS) metadata as described in Section 3.1.3.
  • 3.1.4.3. We do not use the Platform to capture or store photos/videos of individuals or vehicles outside the context of an authorized recovery process.
  • 3.1.4.4. If a photograph or video incidentally includes any other vehicle, individual, or bystander present at the location, the Agency and its field agents are solely responsible for ensuring that such capture is conducted in compliance with applicable laws (including any consent requirements). The Company acts only as a technology provider for the storage and transmission of such content and does not independently verify the legality, context, authenticity, or accuracy of any captured content.

3A. Your Role and Our Role (Data Fiduciary vs. Data Processor)

• 3A.1. In relation to vehicle, recovery, and seizure-related data (including photos and videos) that an Agency uploads or captures through the Platform, the Agency acts as the Data Fiduciary (determining the purpose and manner of such data collection), and the Company acts only as a Data Processor, processing such data solely on the Agency's instructions to provide the Platform's technical infrastructure and storage.
• 3A.2. The Company does not independently verify, and is not responsible for, whether an Agency's underlying seizure, repossession, or recovery action itself complies with applicable laws, regulatory guidelines (including those issued by the Reserve Bank of India or other regulators), or the terms of the relevant loan/financing agreement. That responsibility rests solely with the Agency and, where applicable, the financial institution it is acting on behalf of.
• 3A.3. In relation to information collected directly from you for using the Platform itself (such as your registration details, login credentials, and app usage information), the Company acts as the Data Fiduciary and is responsible for that data as described elsewhere in this Privacy Policy.

4. Why Do We Collect the Information?

• 4.1. The information we collect is utilized for various purposes that are essential to the operation and enhancement of our services. The purposes for which we collect and process personal data are outlined as follows:
• 4.2. To Operate and Improve Our Services
  • 4.2.1. Our platform acts solely as a technology provider and is not responsible for the accuracy, legality, or authenticity of the data uploaded by agencies, NBFCs, and Finance Companies.
  • 4.2.2. Agencies and users are fully responsible for ensuring compliance with financial regulations and legal requirements.
  • 4.2.3. We specifically use your information to provide, operate, and maintain the platform, ensuring that it functions efficiently and effectively for your benefit.
  • 4.2.4. This includes but is not limited to personalizing your experience within our platform, providing location-based services, and improving our offerings, verification purposes, and to maintain the security of your account and to ensure security and compliance within our system, by enforcing policies restricting agency name changes and end-user migration between agencies without proper deactivation of their current active accounts.
  • 4.2.5. We do not verify the authenticity of any imported or uploaded data. The responsibility for using the platform in a legally compliant manner rests solely with the users and agencies.
• 4.3. Registration and Account Creation
  • 4.3.1. The information you provide is essential for creating and managing your account or profile on our platform. This includes storing the necessary details to offer you a personalized experience, facilitating your interaction, and ensuring the proper functioning of our platform's features and services. The data collected through surveys is used to tailor insights, gather feedback, and enhance the services you receive, ensuring they align with your specific needs and preferences.

5. Data Security

• 5.1. We take reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction.
• 5.2. Vehicle and recovery data made available for offline/mobile use is encrypted before being stored on the device, so that it is not readable in plain form if the device is lost or accessed without authorization.
• 5.3. Access to your account is protected using phone number-based OTP (One-Time Password) verification during login.
• 5.4. Access to agency data within the platform is restricted based on user roles, so that users can only view and manage information relevant to their agency and permissions.
• 5.5. While we strive to use commercially acceptable means to protect your personal information, no method of electronic transmission or storage is 100% secure, and we cannot guarantee its absolute security.
• 5.6. The Company does not actively review, moderate, verify, or endorse the content of any photos, videos, or other data uploaded by Agencies, and makes no representation as to the authenticity, completeness, or accuracy of such content for any purpose, including any legal or judicial proceeding.

1. Introduction

Welcome to EasySeizing-Premium, India's first fully automated mobile and web application developed and owned by Big-Byte EduTech (“Company”), designed for Seizer, Recovery, and Collection Agencies. By accessing and using EasySeizing-Premium (“Platform” or “Application”), you (“User”, "Agency", "End User") agree to comply with these Terms of Use. Please read these terms carefully before using our services.

These Terms of Use (“Terms”) govern the User (“You” or “Your” or “Users” or “Customers”) access to and use of the website, the services, and any associated content provided therein. By using or accessing our platform and services (collectively, the “Services”), you agree to comply with and be bound by these Terms.

Disclaimer: Big-Byte EduTech does not engage in, facilitate, or verify any financial transactions, loan recoveries, asset seizures, or debt collections conducted through the Platform. Agencies and End Users are solely responsible for compliance with financial laws, recovery regulations, and contract enforcement.

2. Definitions

• 2.1. For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below:
  • 2.1.1. "Company" refers to Varshaben Harshadkumar Solanki, the sole proprietor operating under the business name Bigbyte EduTech, a proprietorship registered in Mehsana, Gujarat. The Company is responsible for the ownership, management, and operation of the Platform and its related services.
  • 2.1.2. "Agency" refers to any legally licensed recovery and collection agency that has been granted access to use the Platform under the terms and conditions specified by the Company.
  • 2.1.3. "End User" refers to any individual who is registered by an Agency to access and utilize the Platform.
  • 2.1.4. "Services" refer to the comprehensive set of features and functionalities provided by the Platform, including but not limited to secure user registration, real-time GPS tracking, data management tools, compliance tracking mechanisms, and any other associated functionalities designed to facilitate the Agency’s operations.
  • 2.1.5. "System" refers to the entire software architecture of the Platform, including its frontend and backend infrastructure, databases, APIs, security protocols, and user interfaces, which together enable the seamless operation and functionality of the Services.

3. Indemnification

• 3.1. Agencies and End Users agree to indemnify, defend, and hold harmless the Company, its owner, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
  • 3.1.1. Any seizure, repossession, or recovery action initiated or carried out by the Agency or its field agents, including any dispute regarding the legality, manner, or conduct of such action;
  • 3.1.2. Any photographs, videos, or other content captured or uploaded by the Agency or its field agents through the Platform, including any claim by a third party relating to privacy, defamation, or unauthorized capture of their image or property;
  • 3.1.3. Any breach by the Agency or its End Users of these Terms, applicable financial regulations, or recovery-related laws; and
  • 3.1.4. Any data uploaded, imported, or entered into the Platform by the Agency or its End Users, including as to its accuracy, legality, or authenticity.
• 3.2. The Company's role is limited to providing the technology platform, and the Company does not participate in, direct, or supervise any Agency's field operations, seizure activities, or recovery actions.

4. Governing Law and Jurisdiction

• 4.1. This Agreement, these Terms, and the Privacy Policy, and any dispute or claim arising out of or in connection with them or their subject matter (including any non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of India.
• 4.2. Subject to Clause 4.1, the courts at Mehsana, Gujarat shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, the Privacy Policy, the Platform, or the Services, and each User, Agency, and End User irrevocably submits to the exclusive jurisdiction of such courts.
