If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. Terms and Conditions of Use for Big-Byte Edutech's SaaS Platform for Web Application and Desktop Application End User License agreement of Mobile Applications
These Terms and Conditions ("Terms") govern the use of the Mobile and Web Application and also Desktop Application ("Application") provided by [Big-Byte Edutech], hereinafter referred to as "we," "us," or "our" or ”Firm” By using the Application, you ("User," "Agent," or "you" or “Agency”) agree to comply with these Terms. If you do not agree with these Terms, please do not use the Application.
This Terms and Conditions and End User License Agreement ("Agreement") is entered into by and between:
Big-Byte Edutech, a firm registered under the laws of Mehsana, Gujarat, INDIA, with its principal office located at Mehsana, Gujarat, INDIA ("Provider").
and
Any individual or entity ("End User") who accesses and uses the following applications provided by our firm.
Desktop Application: EasySeizing-Live and EasySeizing-Premium
Web Application: EasySeizing-Live and EasySeizing-Premium
Mobile Applications: EasySeizing-Premium and EasySeizing-Live
(collectively referred to as the "Applications").

WHEREAS, firm offers software applications, including desktop, web, and mobile applications (collectively, the "Applications").
WHEREAS, End User wishes to access and use the Applications provided by Firm.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Parties agree as follows:
1. Acceptance of Terms and Conditions
By accessing or using Big-Byte Edutech's SaaS platform ("the Platform") and End User License Agreement of its associated Web Application, mobile applications, Desktop Application EasySeizing-Premium and EasySeizing-Live ("the Applications"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please refrain from using the Platform and the Applications.
2. LICENSE GRANT
2.1. Desktop and Web Applications: Provider grants End User a non-exclusive, non-transferable, revocable license to use the Desktop and Web Applications for their internal purposes, subject to the terms and conditions of this Agreement.
2.2. Mobile Applications: Provider grants End User a non-exclusive, non-transferable, revocable license to use the Mobile Applications on compatible devices, subject to the terms and conditions of this Agreement.
2. Application Use
a. Our Application is intended for use by authorized Vehicle Seizing Agents. You must have the necessary permissions and authorization to use this Application.
b. You are responsible for ensuring the security of your login credentials and for any actions taken under your account.
c. Prohibited Use: End User shall not, directly or indirectly: (a) reverse engineer, decompile, disassemble, attempt to derive the source code, or decrypt the Applications; (b) use the Applications for any illegal or unauthorized purpose; (c) use the Applications in a way that may damage, disable, or impair the functionality of the Applications or the Provider's servers; (d) access or use the Applications in a manner inconsistent with the terms of this Agreement.
3. Compliance with Laws
You agree to use the Application in compliance with all applicable local, state, and federal laws, regulations, and industry-specific requirements.
4. Data Handling
Data Storage on VPS:
a. Data Ownership: Clients retain ownership of all data they store on our rented Virtual Private Servers (VPS). We do not claim ownership of any client data.
b. Data Confidentiality: We consider all data stored on our VPS to be confidential. We will not access or use this data for any purpose other than providing the agreed-upon services, maintaining VPS security, and ensuring the availability of services.
c. Data Security: We implement robust security measures to protect the data stored on our VPS. This includes regular security updates, access controls, encryption, and other industry-standard practices to safeguard data from unauthorized access, disclosure, alteration, or destruction.
d. Data Backup: We maintain regular data backups to prevent data loss and ensure data availability. These backups are securely stored and can be used for data recovery purposes.
e. Data Retention: Data stored on our VPS will be retained for the duration specified in our agreement with the client. After this period, we securely delete or anonymize the data, in accordance with our data retention policy.
f. Third-Party Access: We do not grant third-party access to client data stored on our VPS unless required by law or with explicit client consent.
g. Client Responsibilities: Clients are responsible for the accuracy, legality, and compliance of their data stored on our VPS. Clients should also implement appropriate access controls and security easures within their applications or systems that interact with the VPS.
Big-Byte Edutech, herein referred to as "the Firm," solely provides a data storage and management service for Recovery Agencies, Collection Agencies, Seizing Agencies, firms, enterprises, private limited companies, or any other entities ("Entities"). The Firm does not provide any loan data or other vehicle-related data to Agencies, any individuals, or third parties.
Agencies are solely responsible for collecting data from finance companies and other sources. The Firm does not assume any responsibility for the accuracy, completeness, or legality of the data provided by Agencies.
5. Data Security
The Firm is committed to maintaining the security and confidentiality of the data stored on its Platform and in the Applications. Appropriate measures, including encryption and access controls, are implemented to safeguard the data.
6. Data Isolation and Access Control
The Platform and Applications store data from each Agency in separate, isolated containers to prevent unauthorized access. Access to data is restricted to registered users within each Agency, and the Firm does not allow access to data by third parties or individuals who are not authorized Agency users.
7. Data Backup and Recovery
The Firm maintains a robust data backup and recovery system to prevent data loss and ensure data availability.
6. Disclaimers
The Firm disclaims all warranties, express or implied, regarding the accuracy, reliability, or completeness of the data stored on the Platform and in the Applications.
8. Limitation of Liability
The Firm shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use the Platform and Applications.
The Firm shall not be responsible for any legal issues or liabilities that may arise from the use of the Platform and Applications. All legal responsibility, including compliance with relevant laws and regulations, rests solely with the Agencies.
Agencies are advised to seek legal counsel and ensure that their use of the Platform and Applications complies with all applicable laws and regulations.
This addition makes it clear that the firm is not responsible for any legal issues and that agencies are solely responsible for ensuring legal compliance in their use of the platform and applications. However, it's still important for agencies to use the platform and applications responsibly and within the bounds of the law. Consult with legal counsel to ensure this clause aligns with your specific legal requirements and jurisdiction.
9. Security of Credentials and Liability
Agencies and their registered users are solely responsible for maintaining the security and confidentiality of their login credentials (including usernames and passwords) used to access the Platform and Applications. The Firm shall not be responsible for any unauthorized access or misuse of credentials.
Agencies are responsible for promptly notifying the Firm of any unauthorized access, disclosure, or misuse of their credentials. The Firm will take reasonable measures to assist Agencies in securing their accounts.
The Firm shall not be liable for any losses, damages, or liabilities incurred by Agencies or their users due to the unauthorized access, disclosure, or misuse of credentials.
Agencies are encouraged to implement strong password policies and regularly update their login credentials to enhance security.
Agencies are responsible for ensuring that their registered users comply with these security requirements and are aware of the potential risks associated with the disclosure of credentials to unauthorized parties.
10. Access Rights and Restrictions
Agencies and their registered users are granted access to view and manage their own data exclusively within the Platform and Applications.
Access to data is strictly limited to the information associated with the Agency's own account.
Agencies and their registered users are prohibited from accessing or attempting to access data that belongs to other Agencies or users. Unauthorized access to other Agency data is strictly prohibited and may result in termination of access.
Agencies have the right to view their own agency details and data on the Platform and Applications, including full agency details, as provided during the registration process.
The Firm does not provide access to data from other Agencies to any user, and no data sharing or cross-access between agencies is permitted.
11. Termination
The Firm reserves the right to terminate access to the Platform and Applications for any user or Agency that violates these Terms and Conditions or engages in any unauthorized or unlawful activities.
12. Intellectual Property
All content and materials within the Application, including but not limited to software, logos, text, and images, are protected by intellectual property laws. You may not reproduce, distribute, or modify these materials without our written permission.
13. Changes to Terms and Conditions
The Firm may revise these Terms and Conditions at any time. Users are encouraged to review these Terms periodically to stay informed about any changes.
